办理商品房现房销售备案需要哪些条件?

答:根据《商品房销售管理办法》的要求,商品房现房销售备案办理条件为: 

1、现售商品房的房地产开发企业应当具有企业法人营业执照;                                                                     

2、取得土地使用权证书或者使用土地的批准文件;                                                                                                   

3、持有建设工程规划许可证和施工许可证;                                                                                                          

4、已通过竣工验收;                                                                                                                            

5、拆迁安置已落实;                                                                                                                            

6、已办理首次登记;                                                                                                                                                                                                                                                   

备注:(1)已办理过预售许可证的项目,通过首次登记后停止办理预售许可变更手续,涉及现房销售范围变更的,加收首次登记变更通知书复印件及预售许可证原件办理现售备案手续。                                                                                                                                             

2)收件时须核对营业执照原件及有效期。                                                                                                                          

3)若原系拆迁安置房现转为商品房销售的,须提供土地部门出具的土地取得方式为“出让地”的材料。
